In international arbitration and litigation practice, it is often not only liability but also the recoverability and quantification of damages (“quantum”) that ultimately determines the outcome of a dispute. For claimants and plaintiffs, succeeding on liability may have limited practical value if they cannot prevail on quantum. Conversely, for respondents and defendants, a well-supported quantum case can materially reduce potential exposure even where liability is established.
This seminar brings together our Japan-qualified and Singapore-qualified lawyers and a damages and valuation expert from BRG (Berkeley Research Group) to conduct two panel discussions built around a practical case study to explore the fundamentals of damages quantification and key practical considerations that will guide business decisions and communications at various stages of the transaction or project.
